Article 1 - Conclusion of the contract: The reservation will take effect after the owner has checked the availability of the gîte on the chosen dates. The reservation will be definitive after the tenant has sent to the owner a deposit of 50% of the total amount of the rent and a dated and signed copy of the 5-page contract. A second copy is to be kept by the tenant.
The renting is concluded between the parties signing the present contract and cannot benefit, even partly, a third party, natural or legal person - except with the written consent of the owner.
Any violation of this last paragraph would be likely to lead to an immediate cancellation of the renting in the wrongs of the tenant, and the rental value would be acquired for good by the owner.

Article 2 - Cancellation by the tenant: Any cancellation must be notified by a registered letter sent to the owner.
The amounts which have already been paid remain acquired by the owner.
In case the stay is shortened, the rental fees remain acquired by the owner, and there will be no refund.

Reservations are not guaranteed until a deposit. The deposit is equal to 50% of the total price.
- Cancellation more than 90 days before the arrival date will be retained 30% of the stay;
- Cancellation between the 90th and 60th days inclusive before the arrival: 50% of the stay will be charged;
- Cancellation between the 60th and 30th days inclusive before the arrival: 75% of the stay will be charged;
- Cancellation after the 30th day inclusive before arrival: 100% of the stay will be charged.

Article 3 - Cancellation by the owner: In case of cancellation by the owner, this one will pay back the total amount of the money paid, along with an indemnity equal to the amount which has already been paid.

Article 4 - Arrival / Departure: The rental times are: from Saturday 4 pm to Saturday 10 am, except in case of prior agreement whose particular conditions would be stipulated on the present contract.
The tenant has to arrive on the date and time mentioned on the present contract. In case of late or delayed arrival, the tenant has to warn the owner.
If the tenant doesn't arrive on the day mentioned on the contract without sending any notified warning to the owner within 24 hours, the present contract is considered as cancelled and the amounts which have already been paid remain acquired by the owner who can then have his gîte at his disposal.

Article 5 - Payment: The reservation takes effect as soon as the tenant has sent to the owner a deposit of 50% of the total amount of the rent. The balance has to be paid at least four weeks before the beginning of the rental period. For the reservations made within the beginning of the rental period, the total rental amount has to be paid at the time of reservation.

Article 6 - Inventory: The inventory of furniture and equipments will be made contradictorily at the beginning and at the end of the stay by both the owner or his representative and the tenant. These documents will be signed by both parties. This inventory will be the only reference in case of litigation about the inventory of the places and their equipments. The state of cleanliness of the gîte on the arrival of the tenant will have to be stated in the inventory. The tenant is responsible for the cleaning of the places during the rental period and before his departure. The amount of possible cleaning fees is made out on the basis of figures mentioned on the descriptive list. The owner will not be held responsible in case of temporary interruption of supply by public utilities nor in case of loss, damage or injuries resulting from bad weather conditions.

Article 7 - Security deposit: On the arrival of the tenant, a security deposit of 200 euros is asked by the owner. It is paid at the latest at the time of the inventory at the beginning of the stay. This security is returned after the making out of the adversarial inventory at the end of the stay, after deducting the fees of reparations in case of damages. If the amount of the security is not sufficient, the tenant commits himself to making up the amount after the inventory at the end of the stay. In case of early departure (before the time mentioned on the present contract) preventing the inventory of being made out on the day the tenant leaves, the security will be sent back by the owner within a week.

Article 8 - Length of the stay: The tenant signing the present contract, which is concluded for a limited period of time, will under no circumstances take advantage of any right to staying on the premises at the end of the stay.

Article 9 - Use of the premises: The tenant will enjoy his tenancy in a quiet way so as not to disturb the other residents of the « Clos des Séguineries » and will use it in a correct way, in accordance with the purpose of the premises.
The tenant commits himself to leaving the gîte as clean and tidy as it was on his arrival. Calm is highly wished from 11 pm until 8.30 am and from 2 pm until 3.30 pm.

Article 10 - Capacity: The present contract is made out for the maximum capacity of people indicated on the tenancy agreement. If the number of tenants exceeds the capacity mentioned in the contract, the owner can refuse the additional people. Any change or breach of the contract will be considered at the initiative of the client.

Article 11 - Animals: The present contract mentions whether the tenant can stay or not with a pet, provided it is sociable and well-mannered (not on sofas and armchairs; please bring litter and material). In case of non-respect of this clause by the tenant, the owner can refuse the stay. In that case, there will be no refund.

Article 12 - Insurances: The tenant is obliged to insure the gîte he rents. So he has to check whether the insurance covering his main accommodation also covers the extension for a rented holiday home. In case it doesn't, he has to take out the necessary extension, any robbery during the rental period being chargeable to the tenant.

Article 13 - Tourist tax: The tourist tax collected by the town council will be paid by the tenant according to the rate in force which is posted in the gîte.

Article 14 - Water and Electricity: Water: water supply is included in the rental fees. Electricity: electricity supply is included in the rental fees within the limit of 5 kWh a day, which is largely sufficient for a "normal" use of the facilities at disposal (except heating). In case of exceeding, the extra kWh will be paid in addition according to the rates in force which are posted in the gîte.

Article 15 - Litigation: Any claim relative to the inventory of the premises and the equipment of a rented gîte must be submitted within 3 days after arrival on the premises. The owners will try to find an amicable agreement. Only the court of Saintes has jurisdiction.
